These terms govern your use of thestrategicfounder.com, including applying to a programme, contacting us, and holding an account.
Section 01
By using this site, submitting a form, or creating an account, you agree to these terms. If you do not agree with them, please do not use the site.

In these terms, "TSF", "we" and "us" mean [REGISTERED ENTITY NAME], and "you" means the person using the site.
Needs an answer: Registered entity name and jurisdiction — the same answer as the Privacy Policy needs.
Section 02
TSF is an institution for entrepreneurial formation. We work with founders over a three-month engagement, develop how they think alongside what they build, and back the ones who prove themselves.
We are not an investment adviser or a broker
TSF does not provide investment, financial, legal, tax or accounting advice, and is not registered or licensed to do so. Nothing on this site is an offer to sell or a solicitation to buy any security. If you need advice of that kind, take it from an entity qualified and regulated to give it.
An introduction is not a recommendation
Where we introduce a founder to an investor, or an investor to a founder, we are making an introduction and nothing more. We do not warrant either party, we are not acting as agent for either, and each party remains entirely responsible for its own due diligence and its own decisions.
Section 03
Anyone may apply. We read every application. Beyond that, please be clear about what an application is:

Participation in any programme is additionally governed by [PROGRAMME AGREEMENT, IF ANY], which will be provided to you before the programme begins.
Needs an answer: Do programmes have separate written terms — a cohort agreement, participation agreement, or letter of engagement? If so, this clause should state that those terms govern the programme itself and that these site terms cover only the website and the application.
Section 04
The application form asks you for real detail about your company and your thinking: what you are building and why it matters, your view of the future, your market, your traction, and two essays written for us. It is reasonable to want to know what happens to that.
You keep everything you own
You retain all intellectual property rights in what you submit. Nothing in these terms transfers ownership of your idea, your business, your product, or any material you send us. We claim no stake in your company by virtue of your applying.
You give us permission to store what you submit, read it, discuss it internally, and use it to assess your application and support you. That permission is limited to those purposes.
We will not share your application with any investor or outside party without asking you first and obtaining your agreement — see the Privacy Policy for how that works in practice.

TSF's confidentiality position on submitted material is [CONFIDENTIALITY POSITION — TO BE CONFIRMED].
Needs an answer: Will TSF commit to a confidentiality obligation over submitted material, and does it accept or exclude a founder's own NDA? Most accelerators expressly DECLINE to sign NDAs and disclaim confidentiality, because they see overlapping ideas constantly. Whichever position TSF takes, founders will look for it, and silence reads badly. This needs a decision before launch.
Please do not send us anything you are contractually barred from disclosing, or anything belonging to someone else.
Section 05
If you create an account, you are responsible for keeping your password secure and for what happens under your account. Tell us promptly if you believe someone else has access to it.
We may suspend or close an account that breaches these terms, or where we reasonably suspect fraud or a threat to the security of the service.
Section 06
When using this site, you agree not to:
Reporting a vulnerability
If you find a security flaw, please tell us at contact@thestrategicfounder.com before disclosing it anywhere else. We will not pursue anyone who reports a genuine issue in good faith and gives us a reasonable chance to fix it.
Section 07
The design, text, and code of this site, and the TSF name and marks, belong to us or our licensors. You may read the site, and share links to it. You may not copy or reproduce it, or use our name or marks to suggest an association or endorsement that does not exist.
Section 08
We make no promise that this site will be available without interruption or free of error. We may change, suspend, or discontinue any part of it at any time, and we may do so without notice.
Section 09
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Subject to the above, the service is provided on [WARRANTY BASIS], our aggregate liability is capped at [LIABILITY CAP], and we exclude [EXCLUDED LOSS CATEGORIES].
Needs an answer: The liability position: is the service provided 'as is' with warranties disclaimed, what is the aggregate liability cap, and are indirect and consequential losses excluded? These clauses have to be drafted for the governing law and cannot be lifted from another company's terms.
Section 10
Awaiting legal review
These terms are governed by the laws of [GOVERNING LAW], and the courts of [FORUM] have exclusive jurisdiction over any dispute arising from them.
Needs an answer: Governing law and the forum for disputes. TSF works with founders across Africa and investors internationally, so this is not automatic — it should follow the registered entity.
Section 11
We may update these terms. The date at the top of this page shows when they last changed. If a change materially affects your rights, we will make reasonable efforts to tell you directly. Continuing to use the site after a change means you accept the revised terms.
If any clause here is unclear, or you think it treats you unfairly, tell us. We would rather fix the wording than argue about it later.
